What it makes you log

Logging duty

Section 29A lets a person with lawful access to a work make a copy to carry out a computational analysis of it for the sole purpose of non-commercial research, if the copy is accompanied by a sufficient acknowledgement, and limits what may be done with the copy. The acknowledgement is a credit to the work's author, and the limits on the copy are limits on the copy, not on a log. The section imposes no duty to create, keep, produce or review a log or record, and has no territorial clause of its own.

Research summary

Legal information, not legal advice. This is LexLint's own research summary of a public legal source, and it creates no attorney-client relationship. For decisions that matter, consult qualified counsel in the relevant jurisdiction. About LexLint

Section 29A of the United Kingdom's Copyright, Designs and Patents Act 1988, inserted in the United Kingdom on and not among the provisions the Copyright (Cayman Islands) Order 2015's Schedule excludes or modifies, extends to the Cayman Islands as part of Part 1's general extension.

It permits a person with lawful access to a work to make a copy for the sole purpose of a non-commercial-research computational analysis of anything recorded in the work, with a sufficient acknowledgement, but the copy may not be transferred to anyone else or used for any other purpose without the copyright owner's authorisation, and any subsequent dealing with it is treated as an infringing copy. A contract term purporting to prevent or restrict the making of such a copy is unenforceable.
