Title 7 of Book XI of the Code of Economic Law protects the producers of databases and transposes Directive 96/9/EC. The producer's authorization is required to extract or reuse a database's content, and Article XI.310 lists the cases where it is not required.

Under Article XI.310, paragraph 3, 2°, the producer's authorization is not required to extract the content of a lawfully accessible database for text and data mining, unless the producers have expressly reserved that use in an appropriate manner. For content made available to the public online, a reservation counts as appropriate only if it is made by machine-readable means.

Research organisations, publicly accessible libraries and museums, archives and film or sound heritage institutions may extract the content of databases to which they have lawful access for text and data mining for scientific research without that authorization (Article XI.310, paragraph 3, 1°).
