What this law does
The Protection of Voice and Image Bill 2025 (Bill No. 11 of 2025) is a private member's bill introduced in Dáil Éireann by Deputy Malcolm Byrne on . Section 2 would make it an offence to use, publish, perform, distribute, transmit or otherwise make available to the public an individual's name, photograph, voice or likeness in any medium for advertising, fundraising or political purposes, or to influence elections or referenda.
Section 2 would also make it an offence to distribute, transmit or otherwise make available an algorithm, software, tool or other technology, service or device whose primary purpose or function is the production of an individual's photograph, voice or likeness. Either act would be an offence only where it is done without the individual's prior consent, or the consent of a parent or guardian for a minor or of the executor or heirs of a deceased individual.
The offence also requires intent to cause harm to the other person, or recklessness as to whether harm is caused. A person convicted on indictment would be liable to a fine or imprisonment for up to seven years, or both, and on summary conviction to a class A fine or imprisonment for up to 12 months, or both. Section 3 would require the Minister for Justice to review the operation of the Act within one year of its commencement.
The Act would come into operation on a day or days that the Minister for Justice appoints by order. The Oireachtas record shows the Dáil Second Stage debate on the bill, in private members' time, on . The Oireachtas record lists the Dáil Third Stage, the examination of the bill section by section, as a future stage.
