What it requires
- Do not base a decision that produces legal effects on, or significantly affects, a person solely on automated processing evaluating personal aspects such as their work performance, creditworthiness, reliability or conduct, unless it occurs in entering into or performing a contract at the data subject's request with safeguards for their legitimate interests, or the CNPD has authorised it with safeguards.
What this law does
Article 14 gives every person the right not to be subject to a decision that produces legal effects concerning them or significantly affects them, based solely on automated processing of data intended to evaluate personal aspects such as their work performance, creditworthiness, reliability or conduct.
Paragraph 2 allows such a decision where it is taken in the course of entering into or performing a contract, provided the data subject's request for the contract has been satisfied or suitable measures safeguard their legitimate interests, in particular arrangements letting them put their point of view. Paragraph 3 also permits it when the CNPD authorises it, laying down measures to safeguard the data subject's legitimate interest.
Article 49 puts the whole law into force thirty days after its publication, and no source located states the specific day that computation produces.
