Law on Legal Protection of Compilations of Data, sui generis database right
Law of the Republic of Azerbaijan on Legal Protection of Compilations of Data No. 755-IIQ (, as amended through Law No. 815-VIQD of ), Arts. 6, 9, 10, 13
In force since .
A database right rule binding public and private bodies.
- Obligation class
- Licensing, Access restriction
What it requires
- Extracting or repeatedly using the whole or an essential part of a database that was prepared, verified, or compiled with essential investment requires the producer's permission, whatever the source of the data it contains.
- Obtaining a protected compilation of data by cracking, directly or indirectly, the technical security measures protecting it is illegal use, even where the compilation is also copyright protected.
- No exception in this Law permits extracting or reusing a protected compilation of data for the purpose of training an AI model.

Criminal exposure note
Art. 19 states that a person guilty of illegal use of a compilation of data is subject to civil, administrative, and criminal liability, without stating a fine amount or naming a specific Criminal Code article in this Law's own text.
Statutory damages
Article 15.2.2 lets the court, on the plaintiff's request, award compensation of 110 AZN up to 55,000 AZN instead of damages or the infringer's profits, and Article 15.3 lets the right holder or producer demand compensation for every case of illegal use regardless of whether damage was caused. This is a single per-case range chosen by the right holder, not a negligent and reckless tier or a per-person amount.

Settledness
- As of
- Open questions
- Do data that a producer collected automatically from public sources meet the "essential investments" test of Article 6.1, which Article 6.2 measures by "financial resources" or "considerable investment of time and energy"?
- When does repeated and regular extraction of "insignificant parts" of a compilation of data "contradict normal use" or "considerably injure legitimate interests of producer" under Article 6.4, whose English translation breaks off after "insignificant parts of the content of compilations of data,"?
What this law does
Art. 6.1 gives the producer of a compilation of data prepared, verified, and compiled with essential investment a right to prohibit extraction or repeated use of the compilation, or an essential part of it, applying regardless of whether the content is itself copyright-protected (Art. 6.3). Art. 6.2 measures the essential-investment threshold by financial resources or a considerable investment of time and energy, and newness or the data's own value is not required.
The right runs for fifteen years from the year following the compilation's creation, restarting on a substantial new investment (Art. 10).
Art. 9 lets a lawful user of a database made available to the public extract or reuse an important part of it without the producer's permission when the content is taken by any person for use by non-electronic means, for non-commercial illustration or research in education, or for public safety or administrative or legal proceedings, but carries no text-and-data-mining or AI-training exception.
Art. 13.2 separately treats obtaining a protected compilation of data by directly or indirectly cracking the technical security measures used to protect it as illegal use, regardless of whether the compilation is protected by copyright, by this sui generis right, or both.
The current consolidation, amended up to Law No. 815-VIQD of , changed only Art. 1.0.10, replacing 'mass media' with 'media' in its second sentence, so each provision described here reads as it did in the 2013 English translation; the current text is published on WIPO Lex in Azerbaijani only, with the 2013 English translation offered for reference.
