What it requires

  • Do not intentionally disclose an image, including an AI-generated 'realistic pictorial representation,' of an identifiable person depicted in a state of nudity or engaged in specific sexual activities, where the depicted person has a reasonable expectation of privacy and you intend to harm, harass, intimidate, threaten, or coerce them.
  • Disclosing a realistic pictorial representation of this kind is a class 1 misdemeanor; disclosing a genuine (non-synthetic) image of this kind is a class 5 felony, or a class 4 felony if disclosed by electronic means.
  • An interactive computer service is not liable under this section for content wholly provided by another party, and a disclosure made with the depicted person's consent is not unlawful.

Criminal exposure note

Unlawful disclosure of an image depicting nudity or specific sexual activities is a class 5 felony, elevated to a class 4 felony if disclosed by electronic means; where the disclosed image is a realistic pictorial representation, the offense is instead a class 1 misdemeanor, the same class that applies to a mere threat to disclose.

What it makes you log

Logging duty

Section 13-1425 criminalizes intentionally disclosing an identifiable person's intimate image, including an AI-generated realistic pictorial representation, and grades the offense by whether the depicted image is genuine or synthetic; it creates no duty to log, record, or document an image's creation, alteration, or disclosure.

Arizona's unlawful-disclosure-of-intimate-images statute defines a 'realistic pictorial representation' as an image created or modified to reasonably appear to be an actual image of an identifiable person depicted in a state of nudity or engaged in specific sexual activities that did not actually occur.

Intentionally disclosing an identifiable person's realistic pictorial representation, where the person has a reasonable expectation of privacy and the disclosure is made with intent to harm, harass, intimidate, threaten, or coerce them, is a class 1 misdemeanor. That is a lower tier than the class 5 felony, or class 4 felony if disclosed by electronic means, that applies to disclosure of a genuine, non-synthetic image.
