What this law does
Act No 1322 of implements parts of Directive (EU) 2023/2225 on consumer credit agreements. Where the creditworthiness assessment uses automatic processing of personal data, section 7 c(9) of the Credit Agreements Act, as redrafted by section 1, point 15 of the Act, gives the consumer the right to request and obtain human intervention from the creditor.
That right includes a clear and comprehensible explanation of the assessment, covering the logic and risks of the automatic processing and its significance and effect on the decision, the right to express a view to the creditor, and the right to request a review of the assessment and of the decision to grant credit. Section 7 c(10) requires that the consumer be informed of these rights.
Section 7 c(11) requires the creditor to inform the consumer without delay of a refusal of a credit application and, where relevant, to refer the consumer to easily accessible debt advice services, and in that case also to tell the consumer that the assessment rests on automatic data processing, of the right to a human assessment and of the procedure for contesting the decision.
The Act comes into force on and does not apply to credit agreements concluded before then, apart from the exceptions that section 6 lists.
