What this law does
Section 76-6-703.7(2)(a) provides that an actor commits unlawful computer access if the actor intentionally or knowingly, and without authorization, gains or attempts to gain access to a computer, computer network, computer property, or computer system. Section 76-6-703.7(2)(b) limits the offense to circumstances that do not constitute an offense under section 76-6-703, 76-6-703.3, 76-6-703.5, or 76-12-205. The offense has no result, security-measure or harm element.
A violation is a class B misdemeanor. Section 76-6-703.7(1) applies the terms defined in section 76-6-702. Section 76-6-702(2) defines authorization as having the express or implied consent or permission of the owner, or of the person authorized by the owner to give consent or permission to access a computer, computer system, or computer network in a manner not exceeding the consent or permission. An earlier version of section 76-6-703 carried the same offense in subsection (3)(a).
The Utah Code publishes section 76-6-703.7 in a version effective and superseded . The current text was amended by Chapter 173 of the 2025 General Session.
