On the heads of government of the Länder decided on the draft of a Neunter Staatsvertrag zur Änderung medienrechtlicher Staatsverträge, also called the Digitale Medien-Staatsvertrag Teil 1 or Neunter Medienänderungsstaatsvertrag. They plan to sign the draft by January 2027 at the latest, by circulation procedure.
The draft would make the competent Landesmedienanstalt the market surveillance authority under the KI-Marktüberwachungs- und Innovationsförderungsgesetz where media service providers place AI systems on the market, put them into service or use them to provide media services for journalistic or advertising purposes. The treaty would enter into force on and would lapse if not all instruments of ratification are deposited by .
