Copyright Act, news reporting and quotation exceptions
Copyright Act B.E. 2537 (1994), Section 32 paragraph two (4) and Section 33
In force since .
A snippet reproduction rule binding public and private bodies.
- Instrument type
- an act of a legislature
What it requires
- You may report news through mass media without infringing copyright, if you acknowledge the ownership of the copyright in the work reported on.
- You may make a reasonable recitation, quotation, copying, emulation or reference in part from a copyright work, if you acknowledge the ownership of the copyright.
- Do not use either exception where the act conflicts with a normal exploitation of the work or unreasonably prejudices the owner's legitimate rights; reproducing more than a short, attributed excerpt, or enough to substitute for the original article, falls outside a plain reading of either ground.

What this law does
Section 32 paragraph two (4) excepts news reporting through mass media that acknowledges the ownership of copyright in the work reported on. Section 33 separately excepts a reasonable recitation, quotation, copying, emulation, or reference in part from a copyright work, again with an acknowledgement of ownership.
Both exceptions are subject to Section 32 paragraph one's general condition that the act not conflict with a normal exploitation of the work and not unreasonably prejudice the owner's legitimate rights, so an aggregator reproducing more than a short, attributed excerpt, or reproducing enough that it substitutes for the original article, sits outside a plain reading of either ground.
