  • What counts as a use that is 'výslovne vyhradené' under § 51c(1), given that the provision names no form for the reservation, and does a robots.txt directive or a term in a website's conditions meet it?
  • Does the copying of works to train a generative model amount to 'čerpanie údajov' under § 51c(1)?

Research summary

Legal information, not legal advice. This is LexLint's own research summary of a public legal source, and it creates no attorney-client relationship. For decisions that matter, consult qualified counsel in the relevant jurisdiction. About LexLint

Section 51b, inserted by Act 71/2022 Coll., lets a library, archive, museum, school, or statutory depositary reproduce a work for text-and-data-mining for research purposes without the author's consent, with no rightsholder opt-out. It lets the reproduction be retained for research purposes, including verifying the research results. Section 51c gives any person a general text-and-data-mining exception, defeated where the rightsholder has expressly reserved that use.

A reproduction made under section 51c may be kept only as long as needed for the mining. Section 51b(2) defines data mining, for the purposes of the Act, as any automated analytical technique aimed at analysing data in digital form to obtain patterns, trends, correlations, or similar results.
