What it requires

  • If you are an information-society service provider, obtain the periodical publisher's consent before reproducing its periodical or making it available online, unless the Act provides otherwise (s. 129c(1)-(2)).
  • You need no consent for an individual user's private, non-commercial use, hyperlinking, or the use of a headline, individual words, or a very short extract incapable of substituting for the whole periodical (s. 129c(4)).
  • The right lasts two years from the periodical's publication, ending on the last day of the calendar year in which that term lapses (s. 129d), and does not reach a periodical first published before .

Open questions
  • Does § 129e of the Autorský zákon, which applies §§ 34 to 57 'primerane' to the periodical publisher's rights, let an information-society service provider rely on the quotation exception and the § 51c text-and-data-mining exception against a periodical publisher?
  • Does a headline with a snippet of a given length fall within 'veľmi krátkeho úryvku z periodika, ktorý nie je schopný byť náhradou za celé dielo' in § 129c ods. 4 písm. c), when the Act sets no length?
  • Does the training of an LLM-based chatbot on press publications, or the display of their content in its responses, count as 'vyhotovenie rozmnoženiny periodika on-line' or 'sprístupňovanie periodika on-line' in § 129c ods. 3, the questions referred to the Court of Justice in Case C-250/25?

Section 129c(1) to (2), inserted by Act 71/2022 Coll. transposing Article 15 of the EU Digital Single Market Copyright Directive, gives a periodical's publisher the exclusive right to use the periodical and to authorise its use, so an information-society service provider may reproduce or make the periodical available online only with the publisher's consent unless the Act provides otherwise.

Section 129c(4) exempts an individual user's private, non-commercial use, hyperlinking, and the use of a headline, individual words, or a very short extract incapable of substituting for the whole periodical. Section 129d limits the right's duration to two years from the periodical's publication, ending on the last day of the calendar year in which that term lapses.

A transitional provision excludes any periodical first published before from section 129c. Section 129h requires the publisher to pay rightsholders whose works are included in the periodical an appropriate share of the remuneration it receives from licensing an information-society service provider, within six months of the right's expiry.
