- Which of the measures that Article 38.b(7) of the Zakon o avdiovizualnih medijskih storitvah names, an age-verification system and a user-controlled parental-control system, must a video-sharing platform provider apply to meet paragraph 1, when paragraph 7 introduces them as measures 'zlasti' (in particular) and paragraph 1 requires only 'ustrezne ukrepe' (appropriate measures)?

Article 38.b(4) requires a video-sharing platform provider that stops the spread of unlawful content to keep the disputed video in case the uploader appeals, and paragraph 3 requires the reporter to be told in writing within 15 days how the report was resolved. The Article does not use the words log or record, but the stored video and the reply cannot be produced without them. Article 40, outside this entry, sets a minimum of six months for keeping videos that are the subject of an appeal. The age-verification system in paragraph 7 carries no record duty, and paragraph 8 limits data collected under these measures to verifying age without setting a retention rule.

The provider must also publish rules that set out how users can report breaches, how reports are handled, which measures remove unlawful content, and how complaints against those measures are handled. Data collected under these measures may be processed only to verify a user's age.
