A database right rule binding public and private bodies.

What it requires

  • An app that scrapes, systematically uploads, or otherwise extracts a database created in Mongolia must act consistently with the rights and legitimate interests of the person who created it, and any reproduction of the works or information the database compiles needs a lawful basis under the Law.

These lines are LexLint's reading of the law's text.

  • MAP 4.1Approaches for mapping AI technology and legal risks of its components – including the use of third-party data or software – are in place, followed, and documented, as are risks of infringement of a third party’s intellectual property or other rights.

What it makes you log

Logging duty

Article 24 sets out the lawful user's duties toward a database (not to infringe the rights in its works, not to interfere with normal use or the maker's lawful interests, to use only the part licensed) and article 24.5 bars repeated or systematic reuse of part of a database against the maker's rights; article 23 ends the distribution right when the rights are transferred. None of these requires a log or record, and no territorial test is stated, so the hook is empty. The row cites the legalinfo.mn text of the revised edition; the WIPO Lex page it also cites holds only a catalogue entry.

Article 4.1.6 defines a database as a creatively created systematic compilation of works and information, other than a computer program, that can be independently accessed in an electronic or other network environment, and Article 6.1.12 lists databases among the categories of protected work.

Article 23.1 provides that the person who created a database, or the copyright holder, loses the right to distribute copies of the database in case of transfer of rights, and Article 24 sets the conditions on which a lawful user of a database may use it: not infringing the copyright of the works it contains, not impeding the database's normal operation, and using only the sections the user is permitted to use.

Article 24.5 separately prohibits reproducing, systematically uploading, or otherwise developing part of a database's information in a way inconsistent with the rights and legitimate interests of the person who created it. This is a compilation-style copyright protection folded into the general Law rather than a stand-alone sui generis database right of the kind the EU or UK carry.

The Law's text carries no article that fixes the day it came into force, and no day on which it came into force has been located.
