Electronic Commerce Law, Copyright in Digital Works Chapter

Electronic Commerce Law (2003), Arts. 62-63 (copyright in digital works) and Art. 74 (penalty)

In force.

A copyright and text and data mining (TDM) rule binding public and private bodies.

Audit expectation

What it requires

  • Do not copy, perform, distribute, supply or publish a copyrighted electronic data message without the author's permission.
  • A temporary copy made only because it is an inevitable part of processing a data message on a network is exempt from that permission requirement.
  • No exception in this Law covers copying for text-and-data-mining or AI-model training beyond that temporary, network-processing copy.

These lines are LexLint's reading of the law's text.

In the frameworks

NIST AI RMF
  • MAP 4.1Approaches for mapping AI technology and legal risks of its components – including the use of third-party data or software – are in place, followed, and documented, as are risks of infringement of a third party’s intellectual property or other rights.

What it makes you log

Logging duty

Articles 62 and 63 apply the Iranian copyright laws to a work in the form of a data message and exempt temporary acts of copying that are an inevitable part of processing a data message on networks, and article 74 sets the penalty. They impose no duty to create, keep, produce or review a log or record, and state no territorial clause. The Law's separate provisions on retaining data messages are other articles, not cited by this row.

Research summary

Legal information, not legal advice. This is LexLint's own research summary of a public legal source, and it creates no attorney-client relationship. For decisions that matter, consult qualified counsel in the relevant jurisdiction. About LexLint

Article 62 extends the copyright regime of the Act on Protection of Authors, Composers and Artists Rights (1970), the 1973 translation-and-reproduction law and the 2000 computer-software-producers law to a work in the form of an electronic 'data message', so the right to copy, perform, distribute, supply and publish such a work belongs exclusively to the author.

Article 63 exempts a temporary act of copying, performing or distributing a work where that act is an inevitable part of processing the data message on a network, a caching-style exception that is not conditioned on the copy being made for training or for any other stated purpose. Article 74 makes violating the copyright chapter an offence carrying corrective imprisonment of three months to one year or a fine of up to 50,000,000 Rials.

Neither Article 62 nor Article 63 states a text-and-data-mining-specific rule or an AI-training carve-out; the underlying 1970 Act's own quotation exception (Art. 7, recorded under the aggregation topic for this jurisdiction) is a closed list that reaches no data-mining purpose. None of the Law's 81 articles states a day on which it comes into force. Under Article 2 of the Civil Code a law takes effect throughout the country fifteen days after its publication unless it provides otherwise. No notice stating the resulting day for this Law has been located.
