What this law does
Article 14(1) of Law 50/2024 designates the National Authority for Management and Regulation in Communications (Autoritatea Națională pentru Administrare și Reglementare în Comunicații, ANCOM) as the digital services coordinator under Article 49(2) of Regulation (EU) 2022/2065. Article 18(1) makes ANCOM competent to supervise and ensure compliance with the Regulation by providers of intermediary services from Romania.
Article 5(1) requires a provider of intermediary services from Romania, other than a public authority, to send ANCOM within 45 days of starting to offer services a notice that includes its identification data and its single point of contact under Articles 11 and 12 of the Regulation. Article 5(3) requires the provider to notify ANCOM of any change in those details within 10 days.
Article 8(1) and (2) require an order to act against illegal content to meet at least the conditions in Article 9(2) of the Regulation and to be sent electronically to the contact point the provider designated under Article 11. Article 28(1) allows ANCOM to inspect premises only in exceptional cases, on its own decision and a judicial authorization given by the President of the Bucharest Court of Appeal or a delegated judge.
Article 32(1) points 5 and 6 make it a contravention for a provider not to designate single points of contact for authorities and for recipients, or not to publish the information needed to identify and reach them, as Articles 11 and 12 of the Regulation require.
Article 32(1) points 1 to 4 make it a contravention for a provider not to tell the issuing authority, no later than 10 days after receipt, how it acted on an order under Article 9(1) or 10(1) of the Regulation, or not to tell the affected recipient. Article 33(2) and (3) make it a contravention, fined RON 5,000 to RON 30,000, for a provider from Romania not to send ANCOM the notice required by Article 5(1) in the time and format ANCOM sets.
Article 34(1)(a) fines the contraventions in points 1 to 53 of Article 32(1) from RON 5,000 up to a maximum of 6 percent of the provider's worldwide annual turnover in the previous financial year. Article 34(1)(b) fines the contravention in point 54, supplying incorrect information or obstructing an inspection, from RON 5,000 up to a maximum of 1 percent of the annual income or worldwide annual turnover.
Article 44(1) lets ANCOM impose administrative fines of up to 5 percent of average daily worldwide turnover or income for each day, without combining them with another sanction for the same act. Article 53(1) brought Articles 32, 33 and 52 into force 30 days after the Law's publication in the Monitorul Oficial.
