What this law does
Regulation 3 designates the Garda Commissioner, for the purposes of Article 12(1)(b), as the competent authority to scrutinise removal orders pursuant to Article 4 of Regulation (EU) 2021/784. Regulation 4 requires the Garda Commissioner to carry out those functions in an objective and non-discriminatory manner, while fully respecting fundamental rights, and independently.
Regulation 5 requires the Garda Commissioner, before 1 March each year, to provide the Minister for Justice, Home Affairs and Migration with the information the Commissioner has in that capacity that is required to be forwarded to the Commission of the European Union pursuant to Article 21. The Regulations contain no commencement provision of their own, and no source stating the day they came into operation has been located.
Section 16(3) of the Interpretation Act 2005, subject to its subsection (4), provides that every provision of a statutory instrument comes into operation at the end of the day before the day on which the instrument is made.
