Real Decreto 729/2023 approves the Statute of the Agencia Española de Supervisión de Inteligencia Artificial. Under article 4(1) the Agency carries out supervision, advice, awareness and training tasks aimed at public and private law entities for the proper implementation of all national and European rules on the use and development of artificial intelligence systems, more specifically algorithms.

The Agency also has the functions of inspection, verification, sanction and any others that the applicable European rules give it, in particular on artificial intelligence. Within the competence of the State, article 4(2) makes the Agency the authority responsible for supervising and, where appropriate, sanctioning artificial intelligence systems, in order to eliminate or reduce risks to integrity, privacy, equal treatment and non-discrimination and other fundamental rights.

Among the Agency's purposes is the promotion of real test environments for artificial intelligence systems, to strengthen user protection and avoid discriminatory bias. The decree enters into force on the day after its publication in the Boletín Oficial del Estado.
