Copyright and Neighboring Rights Ordinance-Law, Exclusive Right, Reproduction and Limitations
In force since .
A copyright and text and data mining (TDM) rule binding public and private bodies.
As of .
What it requires
- Do not exploit a protected work without the author's authorization or an assignment of the right of exploitation: the author holds an exclusive intangible property right in the work that is binding on everyone, including the right to exploit it or to assign that right (Articles 1 and 20).
- Treat as a reproduction any material fixation of a protected work by any process that lets it be communicated indirectly to the public, and rely on a limitation in Articles 24 to 32 only where its terms are met; none of those limitations names text-and-data mining or the training of a model on protected works (Article 6(o)).

What this law does
Article 1 gives the author of a work of the mind, purely as a result of its creation, an exclusive intangible property right in the work that is binding on everyone, with intellectual and moral attributes and economic attributes that the Ordinance-Law determines. Article 6(o) defines reproduction as the material fixation of the work by all processes making it possible to communicate the work indirectly to the public.
Article 20 gives the author the right to exploit the work personally or to assign the rights of exploitation, so as to obtain a financial gain where applicable. Article 24 makes it lawful to reproduce quotations or excerpts of protected works for cultural, scientific, teaching, critical or polemic purposes, provided the source, title and name of the author are mentioned. Article 96 makes any malicious or fraudulent violation of copyright, committed knowingly, the offence of infringement.
