Research summary

Legal information, not legal advice. This is LexLint's own research summary of a public legal source, and it creates no attorney-client relationship. For decisions that matter, consult qualified counsel in the relevant jurisdiction. About LexLint

A video-sharing platform provider must ensure that content of gratuitous violence, and content that mainly consists of the unreflective depiction of sexual acts, is subject to effective access control by age verification. The provider must also make content that can impair the development of minors available only in a way that minors do not usually follow it, for example through parental control systems, and must let users rate that content with an easy function.

The duties apply to video-sharing platforms of providers established in Austria within the meaning of the E-Commerce Act. Failing to take the measures that keep harmful content away from minors, or that put content of that kind behind effective access control, is an administrative offence punishable by a fine of up to 150,000 euros.
