- For a data breach affecting fewer than 500 individuals, create an internal incident report as soon as practicable, give it to the Cyber Center on request, and give the Cyber Center an annual report logging all such incidents.

What this law does
A governmental entity that identifies a data breach affecting 500 or more individuals must notify the Cyber Center and the attorney general. A governmental entity must also notify the Cyber Center when it identifies unauthorized access, acquisition, disclosure, loss of access or destruction of data that compromises the security, confidentiality, availability or integrity of its computer systems or information.
The notification must be made without unreasonable delay and no later than five days from the discovery of the data breach. A governmental entity with a data breach affecting fewer than 500 individuals must create an internal incident report and give the Cyber Center an annual report logging those incidents. The section was last amended by Chapter 202 of the 2026 General Session.
