What this law does
Article 7a.1 defines an electronic communications service by reference to Article 2, point 4, of Directive (EU) 2018/1972, excluding transmission services used for machine-to-machine services. Article 7a.2(1) prohibits providing electronic communications services that do not meet the accessibility requirements of Annex I, Sections III and IV(a), to Directive (EU) 2019/882.
Article 7a.2(3) disapplies the prohibitions to providers that run an enterprise with fewer than ten employees and an annual turnover or annual balance sheet total of at most EUR 2,000,000. Article 7a.2(4) disapplies them to the extent that compliance would impose a disproportionate burden on a provider that receives no funding for improving accessibility from sources other than its own resources.
Article 7a.3 names the Authority for Consumers and Markets as the competent national authority under Article 13(4) and (5) of the Directive. Article 7a.4(1) requires service providers to comply with Article 13 of the Directive.
