Copyright Law, citation and quotation exceptions
Law on Copyright and Related Rights (2003), Arts. 25, 28
In force.
A snippet reproduction rule binding public and private bodies.
What it requires
- You may cite a legitimately published work in another work without the author's authorization or any remuneration, provided you indicate the source and the author's name where given and the citation does not exceed the necessary purpose (Article 28).
- You may make short quotations justified by a critical, polemical, pedagogical, scientific or informative purpose, and broadcast press commentary, wherever you clearly indicate the author's name and the work's source (Article 25).
- Rely on these same general grounds for a headline or short extract reproduced with attribution: the Law creates no dedicated press-publisher right, machine-readable opt-out or rule specific to automated indexing.
These lines are LexLint's reading of the law's text.
What this law does
Article 28 permits citing a legitimately published work in another work without the author's authorization and without payment of any remuneration, conditioned on indicating the source and the author's name where given and on the citation not exceeding "the necessary purpose".
Article 25 separately withdraws the author's power to prohibit short quotations justified by a critical, polemical, pedagogical, scientific, or informative purpose, and the broadcasting of press commentary, wherever the author's name and the work's source are clearly indicated.
Neither provision is scoped to a particular medium or reproducer, so a news aggregator reproducing a headline or short extract with attribution falls within the same general ground available to any other quoter; neither provision creates a dedicated press-publisher right, a machine-readable opt-out, or a rule specific to automated indexing. The Law's text names no day for its entry into force, and no notice stating that day has been located.
