What this law does
Section 2:48, paragraph 1 of the Civil Code requires the consent of the person concerned to make and use an image or sound recording of that person. Section 2:48, paragraph 2 makes the consent unnecessary to make and use a recording in the case of a mass recording or a recording made of a public appearance in public life. Section 2:43 g) lists the violation of the right to image and sound recording among the violations of personality rights.
Section 2:51, paragraph 1 lets a person whose personality right is violated claim a court declaration of the violation and an order restraining the violator from further violation. Section 2:52, paragraph 1 lets a person whose personality right is violated claim damages for the non-pecuniary harm.
