Penalty structure
Article 26(4) of Law 4994/2022 makes the EETT the authority that imposes the sanctions in the electronic communications sector as Article 138 of Law 4727/2020 defines them. Article 138(3) of that Law lets the EETT impose one or more of a recommendation, a fine of up to EUR 3,000,000 collected under the Public Revenue Collection Code (which may include periodic penalties with retroactive effect and may be paid in instalments), and an order to stop or delay a service or group of services whose continuation would seriously distort competition while compliance with access obligations imposed after a market analysis is pending. Article 138(5) lets the EETT, in cases of serious or repeated breaches where those measures have no effect, prevent an undertaking from providing networks or services or suspend or revoke its rights of use.

What this law does
Article 22(2) makes the Hellenic Telecommunications and Post Commission (EETT) the competent authority for monitoring and checking the compliance of electronic communications services, in accordance with Article 113 of Law 4727/2020.
Article 22(1) requires adequate procedures to be established, implemented and regularly updated to check the compliance of services and the Article 14 assessment, to follow up complaints and reports about non-compliance, and to verify that the operator has taken the necessary corrective measures. Article 26(4) makes the EETT the competent authority to impose the sanctions in the electronic communications sector, as Article 138 of Law 4727/2020 defines them.
Article 138(3) of Law 4727/2020 lets the EETT impose one or more of a recommendation, a fine of up to EUR 3,000,000 that is collected under the Public Revenue Collection Code, may include periodic penalties with retroactive effect and may be paid in instalments, and an order to stop or delay a service that would otherwise lead to a serious distortion of competition while compliance with access obligations is pending.
Article 138(5) of Law 4727/2020 lets the EETT, in cases of serious or repeated breaches where the measures of paragraph 3 have no effect, prevent an undertaking from providing electronic communications networks or services or suspend or revoke its rights of use. Article 138(3) of Law 4727/2020 requires a person on whom one of those sanctions is imposed to pay the costs of supervision and spectrum monitoring, where they exist, as the EETT decision defines them.
