What this law does
The Code of Conduct sets the principles and procedures that each provider of electronic communications services must follow in providing those services to consumers. The Code counts as the provider's personnel its employees, officers, agents, contractors, subcontractors, partners and resellers and their staff, to whom the provider has assigned consumer matters such as promotion and sales.
Article 3, Part B, item 2 requires communication with consumers, whether by home visit or by telephone, to take place at suitable hours and not during quiet hours, unless the person called agrees. That item applies also to automated telephone calls, which may be made only under the conditions that the legislation on the protection of personal data sets.
Article 3, Part B, item 3 bars the provider from calling consumers who have joined the Article 11 register of Law 3471/2006 and asked not to receive telephone calls for direct commercial promotion of products and services or for advertising of any kind. Article 13 allows the EETT to impose sanctions for a breach of the Code under Articles 137 and 138 of Law 4727/2020. The Decision rests on Article 113, paragraph 2, item c and Article 131 of Law 4727/2020. The Code took substantive effect six months after its publication in the Government Gazette.
