Press publishers and news agencies established in Spanish territory hold the exclusive right to reproduce a press publication, in whole or in part, and to make it available to the public, for online use by information society service providers. The reproduction or making available to the public by third-party users of any text, image, photographic work or mere photograph covered by that right is subject to authorization.

The right does not apply to the private or non-commercial use of press publications by individual users, or to acts of hyperlinking. It does not apply to individual words or very short or insignificant extracts of press publications used online by information society service providers, where that use does not harm the investments of the publishers and news agencies and does not affect the effectiveness of the right. The right lasts two years, counted from 1 January of the year after the date of publication of the press publication.
