What this law does
A custodian may assume that an individual's consent is knowledgeable if it has posted or made readily available a notice that meets the Act's requirements, and one of those requirements is that the notice advises that, if the personal health information is disclosed outside Yukon, the law of the jurisdiction to which it is disclosed will govern its use, collection and disclosure in that jurisdiction.
The written agreement between a custodian and an information manager must require the information manager to inform the custodian promptly when it receives any requirement issued in a proceeding, including a summons, warrant or order, that relates to the personal health information and that it is reasonable to believe may be enforceable in the jurisdiction in which the information manager operates or in which the information is located.
