What this law does
Article 9 of Ley 3729 gives people living with HIV-AIDS the right to confidentiality of their identity and situation, and obliges judicial authorities to protect their identity in every instance of a proceeding by using a code unless the person requests and consents otherwise. Article 9 bars health personnel who learn the identity of a person living with HIV-AIDS through their work from disclosing it in any way, except as the medical and epidemiological protocols provide.
Article 9 also provides that people living with HIV-AIDS may not be the subject of print or television publications without their express knowledge. Article 20 makes HIV-AIDS test results confidential and requires the person's identity to be kept under codes. Article 20 requires any accredited public or private medical center or laboratory that detects a case to notify it confidentially to the National STD/HIV-AIDS Programme of the Ministry of Health and Sports.
