What it requires

  • If you are a physician or run a clinical service in Bolivia, keep medical secrecy: all information identified during the medical act about a patient's state of health or illness, treatment and other personal information must stay secret, even after the patient's death and after you stop providing services (Ley 3131, Articles 3, 4 and 12).
  • Reveal medical secrecy only where the patient or legal representative expressly authorizes it, where you act as a forensic physician at the request of a competent authority, for a notifiable disease, where the health of the family and community is at imminent risk, or where the law expressly provides (Ley 3131, Article 17).

Article 3 of Ley 3131 states that medical secrecy is inviolable in the practice of medicine, including in medical teaching, subject to the exceptions the Act provides. Article 4 defines medical secrecy as all information identified during the medical act about the patient's state of health or illness, the treatment and any other personal information, which must be kept secret even after death to safeguard the patient's dignity.

Article 12 makes it a duty of the physician to keep medical secrecy even after ceasing to provide services. Article 13 lists confidentiality and medical secrecy among the rights of every patient.

Article 17 releases the physician from medical secrecy where the patient or legal representative expressly authorizes disclosure, where the physician acts as a forensic physician at the request of a competent authority, in cases of notifiable disease, and where the health of the family and community is at imminent risk. Article 17 also releases the physician where the law expressly provides.

Article 17 bars the parents, relatives or guardians of a minor from disclosing the minor's medical condition except to comply with the legal rules.
