What this law does
Article 12 of the regulation lifts the Act's prohibition on transfers to countries without adequate protection where the data subject has expressly consented to the transfer. Consent is not needed for a transfer from a legally constituted public register that is open to consultation by the public or by anyone who can show a legitimate interest, provided the legal and regulatory conditions for consultation are met in each case.
The control body may assess, on its own initiative or on request, the level of protection that the rules of a State or international body provide. A State or international body is taken to provide an adequate level of protection when the protection derives directly from its legal system, from self-regulation systems, or from the cover of contractual clauses that provide for the protection of personal data.
